Terms of Sale and Use

Welcome to Nocturne Editions (nocturneeditions.com), based in Ottawa, Ontario, Canada. By browsing the site or placing an order, you agree to these terms. If anything is unclear, email contact@nocturneeditions.com and ask.

Ordering

When you place an order, you are making an offer to purchase. We confirm acceptance by email. In the rare case of a pricing error or a product we cannot supply, we may cancel the order and refund you in full.

Pricing and currency

Prices are shown in Canadian dollars (CAD) or US dollars (USD), selected automatically based on your approximate location. You can usually switch currency manually. The currency shown at checkout is the currency you will be charged in. Applicable taxes are calculated at checkout based on your location. Your bank or card issuer may apply its own conversion rates and fees if it settles in another currency.

Digital products and delivery

Digital sheet music is delivered as PDF downloads, available immediately after checkout via an on-screen link and a confirmation email. Download links do not expire, and there is no limit on how many times you may download your purchase. If you have trouble downloading, contact us and we will restore access; we want you to have your music.

Copies and ensemble use

A standard purchase licenses one buyer; see our License page for exactly what that covers, including personal printing and your own students. Ensemble music works differently: for choral and ensemble editions, you need one copy per performer. A choir of twelve singing a $2.99 octavo needs twelve copies, even digitally. Product pages for ensemble editions state the minimum purchase quantity, and buying fewer copies than you have performers is a violation of the license. If your situation is unusual, write to us and we will find a fair arrangement.

Print-on-demand editions

Printed editions are produced on demand and shipped to the address you provide. Production and shipping times are estimates, not guarantees. Please double-check your shipping address at checkout; we cannot redirect a package once it has shipped. See our Refund Policy for what happens if a print arrives damaged or misprinted.

Intellectual property

This part matters, so here it is plainly. Much of the music in our catalog is in the public domain: the notes themselves belong to everyone. However, every Nocturne Editions publication is a new engraving, meaning a freshly prepared, edited, and typeset edition. That engraving, including its layout, editorial decisions, fingerings, cover design, and typesetting, is an original work protected by copyright and owned by Nocturne Editions.

In short: Beethoven is free; our edition of Beethoven is not. Buying a PDF or printed score gives you a license to use our edition (see our License page), not ownership of the edition itself or the right to copy and distribute it.

Original and contemporary works in our catalog are fully protected by copyright, both the music and the edition, and may carry additional restrictions noted on the product page.

Acceptable use

You agree not to: share, resell, sublicense, or publicly post our PDFs; upload them to sharing sites or sheet music libraries; remove copyright notices or credits; use automated tools to scrape or bulk-download the site; or misuse accounts, including creating accounts with false information.

We may suspend accounts or refuse orders where these terms are being violated.

Accounts

You are responsible for keeping your account credentials secure and for activity under your account.

Custom arrangements

Custom engraving, arranging, and transcription requests are handled by our sister company, Music Notation Hub (musicnotationhub.com), not through this store.

Disclaimers and limitation of liability

We work hard to make our editions accurate and our site reliable, but the site and products are provided “as is” to the extent permitted by law. To the maximum extent permitted by applicable law, our total liability for any claim related to a purchase is limited to the amount you paid for that purchase. Nothing in these terms limits rights that consumer protection law gives you and that cannot be waived.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any disputes will be resolved in the courts of Ontario, except where your local consumer law gives you the right to proceed elsewhere.

Changes

We may update these terms from time to time. The date at the top reflects the latest version. Continued use of the site after changes means you accept the updated terms.
